1. Introduction & Acceptance

Welcome to VidGen AI (“VidGen AI”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of the VidGen AI platform, including our website at vidgen-ai.com and all associated services (collectively, the “Service”).

By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We may update these Terms at any time; continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

VidGen AI is an AI-powered video generation platform that enables users to create short-form video content using artificial intelligence. Users provide prompts, scripts, or other inputs, and the Service generates video content based on those inputs. The Service is designed for content creators, marketers, and businesses seeking to automate and accelerate video production.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable.

3. Account Registration

To access the Service, you must create an account. You agree to:

• Be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
• Provide accurate, current, and complete information during registration and keep it updated.
• Maintain only one account per person. Creating multiple accounts to circumvent restrictions, access free trials multiple times, or abuse the referral program is prohibited.
• Keep your password secure and not share account credentials with others.
• Notify us immediately of any unauthorized access to your account at [email protected].

You are solely responsible for all activity that occurs under your account.

4. Subscription Plans

VidGen AI offers the following monthly subscription plans:

• Free — Trial access for previewing the platform. No credit purchases permitted on the Free plan.
• Basic — $4.99/month — Includes 5 credits per billing period. Limited to 1 topup pack purchase per billing period.
• Creator — $39.99/month — Includes 50 credits per billing period. Unlimited topup pack purchases.
• Pro — $64.99/month — Includes 100 credits per billing period. Unlimited topup pack purchases.

Plan features and pricing are subject to change with notice. Changes to pricing will apply at the start of the next billing period following notice.

5. Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize VidGen AI to charge your payment method on a recurring basis at the applicable plan price (Basic $4.99/month, Creator $39.99/month, or Pro $64.99/month).

Renewal charges are processed on the same day of the month as your original subscription date. You will receive a receipt by email for each successful charge. To cancel auto-renewal, visit your account dashboard before the renewal date. Cancellation takes effect at the end of the current paid billing period; you will not be charged for the following period.

6. Cancellation

You may cancel your subscription at any time from your account dashboard under “Billing Settings.” Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• You retain access to all paid features until the period ends.
• No prorated refunds are issued for unused days in the current period.
• Any unused subscription credits expire at the end of the billing period.

7. Credits & Topup Packs

Credits are the unit of consumption on the VidGen AI platform. Each video generation consumes one or more credits depending on the output.

Nature of Credits: Credits represent prepaid access to VidGen AI computational services. Credits are not a stored value, currency, or gift card. Credits have no cash value and cannot be transferred, sold, or exchanged.

Expiration: Subscription credits expire at the end of each billing period and do not roll over. Topup pack credits expire 12 months after the date of purchase.

Topup Packs allow subscribers to purchase additional credits beyond their plan allocation:

• 10 credits — $9.99 (one-time)
• 50 credits — $39.99 (one-time)
• 100 credits — $74.99 (one-time)

Topup packs are available to paid subscribers only. Free plan users cannot purchase topups. Basic plan subscribers are limited to one topup pack purchase per billing period. Creator and Pro subscribers may purchase unlimited topup packs.

Credits are tied to your account and may not be transferred to another account.

8. Refunds

Our refund practices are governed by our Refund Policy, which is incorporated into these Terms by reference. Please review that policy before making any purchase.

9. Referral Program

VidGen AI offers a referral program that allows users to earn commissions by referring new paying subscribers. Key terms:

• Commission: 20% of the referred user’s first payment.
• Pending Hold: Commissions are held for 7 days after the qualifying transaction to allow for refund and dispute resolution.
• Minimum Withdrawal: $10.00 USD minimum balance required before withdrawal.
• Fraud Prevention: Self-referrals, multi-account abuse, and any form of referral fraud are strictly prohibited and will result in immediate account termination and forfeiture of all commissions.

We reserve the right to modify or terminate the referral program at any time, and to cancel commissions that we reasonably determine were obtained through fraudulent, abusive, or deceptive means.

10. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Prohibited uses include but are not limited to:

• Generating sexually explicit, pornographic, or adult content.
• Creating synthetic media (deepfakes) of real persons without their explicit consent.
• Content depicting minors in any sexual, exploitative, or harmful context.
• Content designed to impersonate, defraud, or deceive others.
• Content promoting violence, terrorism, hate speech, or discrimination.
• Content that infringes third-party intellectual property rights.
• Any content or activity that violates applicable law.

11. AI-Generated Content Disclaimer

Content generated by our AI tools is produced by automated systems and may contain inaccuracies. VidGen AI is not responsible for the accuracy, quality, or appropriateness of AI-generated content. Users are solely responsible for reviewing, verifying, and determining how to use any generated content.

You acknowledge that AI-generated content may occasionally produce unexpected, incomplete, or imperfect results. The Service is provided as a creative tool, and outputs should be reviewed before publication or distribution.

12. Intellectual Property

Your Content: Subject to compliance with these Terms and our Acceptable Use Policy, you retain ownership of any video content you generate through the Service using your own inputs. You grant VidGen AI a limited license to process your inputs and store your generated content solely to provide the Service.

Our Platform: VidGen AI retains all rights, title, and interest in the Service, including its underlying AI models, software, infrastructure, trademarks, and all platform-related intellectual property. You may not copy, reverse engineer, decompile, or create derivative works based on our platform.

13. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for violations of these Terms, our Acceptable Use Policy, or for conduct we determine to be harmful to other users, third parties, or the Service.

Upon termination, your right to access the Service immediately ceases. You will not receive a refund for any unused credits or remaining subscription period if termination is due to a violation. You may also terminate your account at any time by contacting us at [email protected].

14. Limitation of Liability

To the maximum extent permitted by applicable law, VidGen AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to VidGen AI in the 12 months preceding the claim, or (b) $50 USD.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-generated outputs are provided without any warranty as to their accuracy, completeness, or fitness for any particular purpose.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

17. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration or litigation in the courts of the State of Delaware.

You waive any right to participate in a class action lawsuit or class-wide arbitration against VidGen AI.

18. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and, where appropriate, by email. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
